The Demise of the 28-Clause Peace Initiative for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe experienced widespread relief on Monday, as the crisis sparked by the introduction of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been stabilised. A American diplomat spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its retaliation: an extensive attack of aerial bombardment on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of conflicting incidents captured the bleak nature of the outgoing year. By day, negotiation efforts are fought: hopeful statements are released from different nations. Immense energy is devoted on containing certain initiatives. By night, the Kremlin clearly shows the world that, for them, war remains the primary tool for achieving "resolution".

Nighttime Reality

As the offensive progressed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was laid bare. Ukraine is able to track projectile deployments from Russian territory, a ability afforded by timely intelligence. From vantage locations, defense planes that had been deployed to intercept incoming guided weapons flew past – sophisticated military planes provided to Ukraine by European allies.

Shortly after, Kyiv's anti-aircraft weapons engaged: multiple launches targeted at a hostile projectile. This was a modern interception technology at work, probably supplied through partner states. Every firing jolts you unexpectedly, causing tremors. The moment of terror quickly becomes resigned acknowledgment: possibly the hostile projectile won't cause damage this time, preventing destruction from devastation and further power outages.

Persistent Threats

Not long after, a heavy machine gun opened up on a aerial vehicle close by, part of a rapid response unit – probably imported technology. Regrettably, the shots failed to hit the enemy aircraft – it maintained course toward its objective.

Intermittently, this persisted until dawn. Kyiv greeted the daybreak reports: multiple fatalities, devastation and heating outages in multiple buildings as a result of the evening attack. As typically, everyone still maintained normal activities – living the war. But those full day encapsulated Ukraine's essential dependence on international aid – a dependence that neighboring countries are demonstrably unable to substitute in the immediate future.

Failed Diplomacy

The detailed framework from Washington sparked intense emotion, debate and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after prior negotiation attempts and multilateral gatherings.

Every new approach from American administration unfolds according to the identical sequence: a political offensive against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They manage the tension but never actually achieve victory. This cycle will, undoubtedly, persist.

Strategic Calculations

It is easy to blame specific actors of consistently pushing Kremlin's demands. But that does not seem to be the entire situation. US administration operates on a premise understood by international relations experts: you cannot secure via talks what you have been unable to protect through force. The White House believes that it is unrealistic to force Russia to relinquish the territory that it presently holds in Ukraine's southern or eastern regions.

The problem is that while recognising this factual reality, American administration does nothing to discourage Russia, through words or deeds, from assuming that the current condition will not change more in its advantage in the near future.

Opposing Positions

Therefore, the Kremlin is confident that the clock favors them – that Ukraine and its allies are nearing depletion. Their incentive to sign a deal that does not give them the greatest potential benefit is close to zero. There may be numerous efforts to achieve ceasefire, but they will persist as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing civilians and areas but averting a total frontline collapse until conditions improve in its benefit.

Current Realities

Realistically, there are no genuine requirements for a truce. Now, subjective factors are becoming relevant: political desires to broker a ceasefire and obtain worldwide acknowledgment, and Ukrainian leadership's dual difficulties – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the flag against any initiative Kyiv finds unsuitable, so that their attention does not move to internal issues. And although their objective will now be much harder after current events, it remains quite doubtful that this will modify their basic position.

These two forces are driving the talks.

Summary and Prospects

It took a just a single week to kill the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by American leadership, opposition by Ukraine and the rest of Europe, along with calming attempts of representatives, and finally, current information leaks, all did their job.

While new proposals based on established approaches are imminent, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and show certain reluctance to alter the situation, if they maintain solidarity and strengthen their defence capabilities at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the predictable period, mainly require ongoing international assistance.
